$1.45 Million settlement reached in Whistleblower case with PAE Government Services Inc and RM Asia (HK) Limited

A settlement has been reached in a whistleblower class action lawsuit brought against PAE Government Services Inc (PAE) and RM Asia (HK) Limited (RM Asia). They are accused of violating the False Claims Act by taking part in a bid-rigging scheme that resulted in false claims for payment under a U.S. Army contract for services in Afghanistan.

The whislteblower will receive a $261,000 share of the government's recovery.

The whistleblower case, filed in 2011, alleged that former managers of PAE and RM Asia funneled subcontracts paid for by the government to companies owned by the former managers and their relatives by using confidential bid information to ensure that their companies would beat out other, honest competitors.   

In a related criminal investigation, the U.S. Attorney’s Office of the Eastern District of Virginia previously obtained guilty pleas from former PAE program manager Keith Johnson; Johnson’s wife, Angela Gregory Johnson; and RM Asia’s former project manager, John Eisner, and deputy project manager, Jerry Kieffer, for their roles in the scheme.

$11.75 Million Settlement reached in Whistleblower case with Science Applications International Corporation

A settlement has been reached in a whistleblower class action lawsuit brought against Science Applications International Corporation who is accused of charging inflated prices under grants to train first responder personnel to prevent and respond to terrorism attacks.

The whistleblower's share of the recovery has not been determined. 

The case, filed in February 2012, alleged that SAIC’s cost proposals falsely represented that SAIC would use far more expensive personnel to carry out its efforts than it intended to use and actually did use, resulting in inflated charges to the United States.

Between 2002 and 2012, the New Mexico Institute of Mining and Technology (New Mexico Tech) received six federal grants from the Department of Justice, the Department of Homeland Security, and the Federal Emergency Management Agency to train first responder personnel to prevent and respond to terrorism events involving explosive devices.  New Mexico Tech awarded subgrants to SAIC to provide course management, development, and instruction.

$30 Million Valued Settlement reached in Whistleblower Case with US Investigations Services Inc

A settlement has been reached in a whistleblower class action lawsuit brought against US Investigations Services Inc (USIS) and its parent company, Altegrity, who are accused of failing to perform required quality control reviews in connection withbackground investigations that USIS held with the U.S. Office of Personnel Management (OPM).

According to the settlement details, the companies have agreed to forgo their right to collect payments that they claim were owed by OPM, valued at least at $30 million, in exchange for a release of liability under the False Claims Act.  

The whistleblower's portion of the recovery has not been determined.

The case, originally filed in July 2011, alleged that beginning in at least March 2008 and continuing through at least September 2012, USIS deliberately circumvented contractually required quality reviews of completed background investigations in order to increase the company’s revenues and profits.  Specifically, USIS allegedly devised a practice referred to internally as “dumping” or “flushing,” which involved releasing cases to OPM and representing them as complete when, in fact, not all the reports of investigations comprising those cases had received a contractually-required quality review.  The government contended that, relying upon USIS’ false representations, OPM issued payments and contract incentives to USIS that it would not otherwise have issued had OPM been aware that the background investigations had not gone through the quality review process required by the contracts.

$42.5 Million Settlement reached in Whistleblower case with Alpharma Inc

A settlement has been reached in a whistleblower class action lawsuit brought against Alpharma Inc who is accused of paing health care providers to induce them to promote or prescribe their drug, Kadian.

According to the settllement, the United States will receive $33.6 million to resolve the federal claims and the states will receive approximately $8.9 million to settle their respective claims. The whistleblower will receive $5.33 million out of the federal share of the recovery.

The original case was filed in September of 2006.  The United States alleged that, between January 1, 2000 and December 29, 2008, Alpharma paid health care providers to induce them to promote or prescribe Kadian, and made misrepresentations about the safety and efficacy of the drug, which is used to treat chronic moderate to severe pain. A

$1.375 Million Settlement reached in Whistleblower case with Harborside Healthcare and HHC Nutrition Services

Settlement Amount:

A settlement has been reached in a whistleblower class action lawsuit brought against Harborside Healthcare and HHC Nutrition Services.  They are accused of receiving kickbacks and assistance under the guise of a sham durable medical equipment (DME) provider.

The whistleblower will receive a $275,000 share of the government's recovery.

Originally filed in October 2008 against McKesson and MediNet, the United States alleged that Harborside Healthcare and HHC Nutrition Services received kickbacks and assistance and, in return, Harborside purchased its DME, such as non-enteral supplies, from McKesson.

$1.4 Million Settlement reached in Whistleblower lawsuit with AT&T Missouri

A settlement has been reached in a whistleblower class action lawsuit brought against AT&T Missouri (formerly known as Southwestern Bell Telephone L.P.), who is accused of engaging in non-competitive bidding practices for Federal Communications Commission contracts.

The whistleblower will receive a $195,000 share of the government's settlement.

Originally filed in 2006, the United States alleged that the Company violated the False Claims Act in connection with the Federal Communications Commission's E-Rate program. 

The E-Rate program, which Congress created in the Telecommunications Act of 1996, provides funding for needy schools and libraries to connect to and utilize the Internet. Under the program, which is supported by fees collected from telephone users, schools apply for funds to pay for hardware and monthly connectivity service fees.

The government's complaint asserted AT&T Missouri provided false information to the E-Rate program and otherwise violated the program’s requirements by engaging in non-competitive bidding practices for E-Rate contracts. The United States further alleged that AT&T Missouri employees colluded with officials in the Kansas City, Mo., School District to award contracts to the company, extended contracts in violation of E-Rate rules and provided meals and other inducements to school district employees.
