$200 Million Settlement reached to resolve False Claims Act Allegations against US Bank

Settlement Amount:
$200,000,000

US Bank agreed to pay $200 million to resolve allegations that it violated the False Claims Act. US Bank was under investigation by a joining of HUD, its Office of Inspector General, the Civil Division of the Department of Justice, and the United States Attorney’s Offices for the Northern District of Ohio and the Eastern District of Michigan.  The investigation was based upon allegations that US Bank was knowingly originating and underwriting mortgage loans insured by the Federal Housing Administration (FHA) that did not meet applicable requirements.

US Bank admitted that, from 2006 through 2011, it repeatedly certified for FHA insurance mortgage loans that did not meet HUD underwriting requirements. US Bank also admitted that its quality control program did not meet FHA requirements, and as a result, it failed to identify deficiencies in many of the loans it had certified for FHA insurance, failed to self-report many deficient loans to HUD, and failed to take the corrective action required under the program. US Bank further acknowledged that its conduct caused FHA to insure thousands of loans that were not eligible for insurance and that the FHA suffered substantial losses when it later paid insurance claims on those loans.

$161.7 Million Settlement reached in Veterans Home Refinancing Whistleblower case with six banks

Settlement Amount:
$161,700,000

A settlement has been reached in a whistleblower class action lawsuit brought against six large banks who are accused of charging military veterans with hidden fees on home refinancing loans.

The out-of-court settlement, reached November 19 in federal court, allows for a fund of $161.7 million to be paid by the six banks to the class. The banks are Countrywide Home Loans Inc., PNC Bank, First Tennessee Bank, SunTrust Mortgage Inc., CitiMortgage and JPMorgan Chase Bank.

The class action lawsuit also names Wells Fargo & Co. and Mortgage Investors Corp as defendants, and they will proceed to court as the judge rejected their motion to dismiss.

Filed in 2006, the lawsuit alleges the banks cheated the veterans and American taxpayers out of millions of dollars by hiding illegal fees in home mortgage refinancing transactions and seeking to collect on federal loan guarantees when loans went into default.
